Can a person only be prosecuted if a TV licence officer has accessed the home and seen that a TV is in use with no licence?
Or can they prosecute anyway even if no one was ever at home to answer?

It isn't illegal to use a TV without a licence, its illegal to receive a TV signal.
How evil is that mind you thats probably the one day of the year nearly everyone will be in gawping at the TV.
I remember a few years ago i swear there was a bloke who tried to get out of paying for his TV licence by claiming he only watched ITV.
