TV licence prosecution

Can a person only be prosecuted if a TV licence officer has accessed the home and seen that a TV is in use with no licence?

Or can they prosecute anyway even if no one was ever at home to answer?

    Well, they can prosecute regardless, but they'd have a good job proving that you were illegally receiving a TV signal without seeing that you were receiving a TV signal.

    It isn't illegal to use a TV without a licence, its illegal to receive a TV signal.

    They have to prove that you were receiving a tv signal. So they'd have to have seen a tv on and showing live tv through a window or something like that to prosecute.

    We saw the TV licencing people with their detction van out on boxing day!

    How evil is that mind you thats probably the one day of the year nearly everyone will be in gawping at the TV.

    I remember a few years ago i swear there was a bloke who tried to get out of paying for his TV licence by claiming he only watched ITV.
