Judiciary vs. Parliament

Former MemberFormer Member Posts: 1,876,323 The Mix Honorary Guru
Following this ruling yesterday David Blunkett said that he was "fed up" with the judiciary overruling the will of Parliament.

Is he right to be concerned?

Is the judiciary be there to keep Parliament in "check"? Or should Parliament be the ultimate power?

The role of the judiciary is to interpret legislation and not necessarily solely to keep the legislature 'in check'.

Since there is no seperation of powers in the British system, there would naturally be cases in which one branch of government overrides another.

Shows some of the confusion in our backward old system.....

I think that parliament should be able to introduce laws as it wants but that the judiciary should be there to ensure that these laws do not contevene European or international law.........

There should be clearer seperation and definition of the roles of the three sectors of the administration........

But how is this possible? The US Constitution allows for each branch of government to check each others' powers. How could something like that be implemented into the British system?
