Work Discrimination

Former MemberFormer Member Posts: 1,876,323 The Mix Honorary Guru
So, I don't know if this is in the right section on not, but on with the jam.

I recently got discriminated at work for my mental health and sacked there and then, I don't know who I'm supposed to contact for advice on this or if any action can be taken? I wouldn't normally fuss with stuff like this, but I feel as though I should take it further..

Advice please!!

Have you contacted someone like ACAS? Mind might be able to help too.

No I've not, I'll have a look though.

I tried seeing if there was anyone higher up that her that I can make a complain too, but there is no one higher up than her, I have to take it to the board meeting, but not worked out who I'd tell atm.

    What actually happened?

They where well aware I had mental health from when they accepted me into the work place. And they organised an appointment with the Duty Officer for me, on Monday just gone. Myself and the manager had a massive brawl on Friday, which lead to me scratching my hand cos I was anxious. She now says I 'self-harmed' in front of her.

When I came back from my appointment on Monday, she had asked if she could have a word with me and told me she has to protect the others, and think of the centre, then told me until I 'sort myself out' and 'get the help' that she no longer wants me to work with her, but will re think this in 6 months time if I've recovered...

    Hello SophiePea,

My response is going to rather useless, just wanted to offer you *hug*'s. I don't really see this as being work discrination, just keeping the safety of other people in mind. To be honest scraching yourself on purpose in front of her wasn't the best thing, I think in situations like you've just mentioned, it's just about asking for five minutes to calm down, and you're in a working enviroment, so that would be a useful skill to have.

She's not canning you in a discriminative way, due to your mental health issues, more due to needing to look after yourself, and other arounds you, by the sounds of things? What did you do job wise?

    Best wishes,
    Angel

It was discrimination a lot of people have agreed. She said she never treated me different but when she found out about mental health she was frightened of working with me. It wouldn't have been discrimination if I didn't mention my mental health to her, but as I did, it comes under it, and it's unfair what she had done.

I did take a break when I finally came to the earth again and figured out what I was doing, I asked to go to the bathroom to clean it up, and she was okay with that.

I'm not a violent person, and the job centre today agreed she went about it the wrong way. But I'm going to see CAB and get advice from them as well.

CAB are good, but ACAS are more specialised. Mind also have a dedicated legal infoline that might help: 0300 466 6463, legal@mind.org.uk

Good call on Mind infoline picc - I meet someone who works on it the other day and they were really friendly :)

It sounds like an upsetting experience and getting some outside support will help you to be really sure about where you stand and what your options are.

Keep us posted on how things progress, hope you're doing okay *hug*
