Housing benifit claim if not on tenancy agreement?

My brother lives with his girlfriend and baby, he pays 800 pcm on the rent.

They have split up,

He is about to move into a 600pcm rent flat.

She will stay in the 2bed house

He is the only one on the previous tenancy agreement so when his ex girlfriend cant afford to pay the rent will the council help her with housing benifit or will they say, her ex is on the tenancy agreement so he has to pay it even though he doesnt live there?

    She will have to show that she is responsible for the rent and that she will be evicted if she doesn't pay the rent.

    However the housing benefit won't be her concern. If she's not on the tenancy agreement then she might not be legally allowed to live there once your brother moves out. She should get herself put on the agreement ASAP.

    It's also highly unlikely that she would get the full £800pcm rent as the law sets a maximum housing benefit according to house type and area.

    Arctic Roll's reply is great and sums up the position about your brother's girlfriend's situation.

    I'd just like to add that as long as your brother remains on the tenancy agreement he will be liable for rent; even if his girlfriend is living there and he is not.
    Therefore, he might like to consider making sure the landlord/letting agent knows that he is going to be moving out.
