Can an employer force employees to use there holiday entitlement when there place of work is closed for refurbishment?Anyone help please?

    Yes, an employer can tell you when you have to take your holiday entitlement.

    I have to use annual leave at Christmas and Easter when my place of work is closed.

    This sounds a bit frustrating for you :banghead:and it's understandable that you might not ideally want to take leave when your employer wants you to.

    Sorry for coming in late with a reply, but just wanted to show you this article on direct.gov and this article about Holiday entitlements on TheSite Both might help you understand your rights around holidays. As you'll see on third bullet point down on the direct.gov article your employer 'can control when you take your holiday'. If you also have a look at the taking holiday fact-sheet it says 'your contract may set out other rules about when you can take your holiday. This is allowed so long as the rules don't effectively prevent you from taking holiday at all'.

    If you are still in doubt it might be worth having a look at the contract you signed when you entered into employment with them. You could also have a chat with your HR Manager/Advisor if you have one, as they should be an expert on these type of issues.
