Is sex on the beach illegal?

Was reading this article and came across this.

Section 66 of the Sexual Offences Act 2003 - which bans exposing one's genitals if the intention is to cause alarm or distress - can also be applied in England, Wales and Northern Ireland

Doesn't the above basically cover anyone being naked in public?, Our ancestors walked the earth practically naked and some of just over a third of the worlds poulation still walk the earth almost, and totally naked, so what is britians fear of a naked person?

    The above covers naked people in public basically, which our ancestors and over one third of the worlds population still live practically naked. What is Britians fear of a naked person?


    Because we are neither our ancestors nor other parts of the world.

    Practically naked isnt the same as naked either.

    Someone who is practically naked isnt actually naked.

    Otherwise you would say "they are naked" instead of "they are practically naked"

    I really asked what is britians fear of a naked person? What I didn't ask was, Who are we?

    You stated a load of items to support something, those items i believe to be slightly irrelevant and non applicable, so thats why i brought them up.

    Fear of a naked person, i dont know if its conditioning, but theres some people that when i walk down the street, i would not want to be distracted by them being naked.

    When you say some of just over a third, so you dont mean just over a third of the worlds population, you just mean some of them?

    I find it hard to believe that 2.2billion people
    and some of just over a third of the worlds poulation still walk the earth almost, and totally naked

    And the original article actually asks is sex on the beach legal, not "is it illegal as you have stated in the title.

    Interesting wording. How does one prove intention?

    Regardless, I think that as long as people aren't doing anything sexually explicit with their genitals, they should be allowed to be completely naked anywhere that there's not a specific type of clothing required.

    You must have strong english language skills, I do not, so you may not understand what I was suggesting.

    other cultures have different morals. That's hardly a contentious point.

    And our ancestors only had fire and stone tools. Is that what we should have? if it was good enough for our ancestors then it's good enough for us, right?

    it probably means mens rea. In a crime, there must be a guilty act as well as a guilty mind.

    The sexual offences act 2003 is completely irrelevant in the case of having sex on the beach.

    For that you'd be looking at indecent exposure or outraging public decency.

    Your only defence to either is if you have done your best to pick a secluded spot, so having sex in the middle of a beach when it's likely you'll be stumbled upon is an offence. Finding a sand dune somewhere off the beaten track and it isn't.

    If anyone comes across you and reports you, you'd have broken the law.

    If nobody sees you nobody is outraged and it's not illegal, even if you freely admit to having done it.

    Not always, chances are you'd be arrested but again your defence is that you thought it was a pretty secluded spot. It's one of the main points to prove to make the offence.

    I don't think it's fear as such. I wouldn't say we are that conservative a society anyway. Besides, would you say that India (for example) by and large tolerates public nudity? There are societies that have far more conservative morals than the UK ostensibly has.

    There are too many laws about sex in this country. As far as I'm concerned, it's completely inappropriate for any government to tell us what we can and can't do in the bedroom. What happens between two consenting adults (or more, if that's your scene) behind closed doors is entirely their own business.

    Sex on the beach is almost certainly illegal under the law as it stands, and I probably agree with that. Let's face it - when you're taking the dog down the beach for his walk, you're not especially likely to welcome the sight of some couple copping off. Or when I'm going into public toilets, I don't especially fancy seeing two blokes engaging in a bit of cottaging. Nothing against gay sex, you understand - I just think there's a time and a place for everything.

    But you can bet you'll be on youtube within 5 minutes if someone finds you with their camera phone!

    I honestly dont have a problem with casual nudity at all. But we live in a very sexualised world so unless you are skinny dipping with your best friends, if you get your dong out people are going to be thinking you want to rape them or that they want to rape you. People just can't handle that kind of thing. If everyone walked around naked it wouldn't be a problem, but at the minute the only people that do are the ones who are a bit loony.

    What is the situation on a sunny day if I strip my kit off and just sunbathe nude? I wouldn't for fear of causing offense - waiting in a car park last night for my mate to pick me up caused offense (I was literally sitting not saying anything and heard mutters of 'teenagers...' coming my way - this wasn't in inner city Nottingham either, this was Cromer a sea side town!).

    There was a funny sketch about the whole issue on the thin blue line once.

    Where are you sunbathing? Are you on a nudist beach, or Skegness beach amidst loads of young families. If it's the latter and you're more than topless, then you're collar will be felt pretty sharpish.
