drunk and disorderly, aye??????????

I was arrested for a public order ofence a week after the alleged incident. A officer stated that he recognised me from previous dealings and that in his statement I was drunk and gobbing off etc. I denied the incident as it honestly didnt occur and they then charged me with Drunk and Disorderly??? I am awaiting court, surely this cant be right????

    As always I will recommend you get some specialist legal advice, but some general points to consider:
    - what evidence do they have? Just one PC?
    - do you have an alibi? Someone you were with, or somewhere you were?

    Pay attention to what Kermit says as he works in the legal profession.

    What seems a bit dodgy to me, is that a week later he charges you with drunk and disorderly. That's just being noisy / drunk. Why would he remember, why did he not charge you at the time?

    There seems to be a lot of holes on the police side but then again, the law is very much in their favour. It may come down as kermit said in the other thread to your word against his. Were you going out and drinking that night? Or was it just completely spurious accusation?

    I was just going out froa night out with friends and my partner. A doormen at a bar singled me out and said to me your not coming in as he said I was drunk. I had just come out for the evening and had 1 pint. I protested and tried convince the doormen to let me in but he refused. At this point a offficer comes over and says your not going in, therefore I walked off. A week later the officer, doormen comply statments saying that I was abusive and drunk. I must point out that there were several high-vis officer on foot there at this time so Idont understadn that why I wasnt arrested there if any offences had been committed. I have my partner and friend to state that I wasnt drunk.

    It seems like a case where you're screwed - they have no material evidence (didn't breathalyse you / arrest you at the time) so it's your word against theirs and who's the magistrate going to believe?

    I'm not a legal person at all, just giving my opinion, and would advise you to get some legal advice. Did he say it was a fixed penalty but then you refused it? Anyway:
