Waiving your notice

My girlfriend has given two weeks notice at work as a transport planner; she has been there for 3 months, a trial period. She has decided that it is not for her, the boss is a cock and she has had no formal training in the area from the company.

Basically she handed her notice in yesterday and gave 2 weeks which was part of her contact. However today the boss was sarcastic and acting like a child because she is leaving. She was in tears tonight and doesn’t want to work the two weeks.

She would like to know whether she can waive her two weeks notice tomorrow by writing a letter and not turning up. Does she risk being sued for breach of contract???

    She would probably lose whatever pay she still has owing, I doubt that they would sue her, she could always check with citizen's advice or something similar.

    If it's so bad that it's affecting her health then her doctor could sign her off anyway.

    She should ring ACAS tomorrow and find out, to be quite honest. ACAS are the best people to ask about employment matters, as they are the impartial mediation and empolotyments rights service in the UK.

    If she was employed on a three-month trial then she may not have to give or work notice. Her employer can waive their rights to notice.
