should britain adopt a written constitution

Former MemberFormer Member Posts: 1,876,323 The Mix Honorary Guru
i think so, and with a thing like it has to be a 2/3 majority to get through

and maybe a bill of rights would be good to

itll lay out who can do what etc etc and in one or 2 documents not the multitude of things over the past thousand or so years

How would the EU Treaty on Human Rights fit into that?

It would over ride anything we wrote and put into law here.

well thatd only affect a bill of rights, for a constitution it wouldnt have too much effect, like trial by jury isnt part of it, when that could be included for example

thats why im defeintly for a eu constituation, but not one as we see at the moment which is all legal mumbo jumbo, it should just say "the eu has this power, and this is how the eu will vote on it, and nation states have these powers, and these can be implemented in anyway as long its democratic by the countries judicary, and if necessery the european courts"

    Why do we need one?

Because in theory they are a good thing to have, simple rules which governments should abide by.

In practice though they offer no protection at all because they are applied unevenly if at all.

It was more, why do we need one NOW as opposed to the collection of stuff we've got?

The discussions around creating it and the creation of simple rules for government to follow may foster a greater sense of unity of purpose and also engage people in the politcal process.

What you get in practice are things like the "patriot" movement in the US. From the governments POV they aren't a good thing because they so obviously have to violate things like the "bill of rights" just to do their day to day business. People put up more of a struggle if they think they are entitled to something.

As far as waking the average citizen up a bit into just how much shit goes on in his or her name, I think they are a good thing.

Britains unwritten constitution is an asset imo.

Don't we have the magna carta?

That is part of the constitution but it can be made invalid with a single act of parliament( which is the weakness of an unwritten constitution).

Like the ten commandments in the bible? Surely we as humans follow simple rules anyway. Isn't the queen the head of the church or something under jesus? That is reasonably simple isn't it?
Fair enough, we all break the rules from time to time, but we all know them. Why add more rules to confuse the issue?
Why change imperial measurements to metric. It's all bolocks. just cuts off a generation...

not if it was done properly

and metric makes far more sense in the sciences, thatd be confusing in imperial :shocking:

to be honest, anything can be repealed by parliament, including the act of european sucession, fair enough its very unlikely we would repal it, but we could in theory

and to be honest i know its semantics, but we do have a constitution that is written, its just uncodified into a single document
