so, why is it that Saddam, on his capture is not being treated in the same way as say those in Guantanamo Bay or those being held under anti terrorism laws?

Because Saddam was a despot and a leader of state not a "terrorist" as currently defined. If not then many of our world leaders including our own in the West could similarly be charged as terrorists. "War Criminal" is the moniker reserved for the leaders of countries we conquer.

Did you notice how on the same day Donald Rumsfield talked about how they were going to treat him under the Geneva Convention, and then pictures were released of a medical examination? I was quite impressed how quickly they managed to break it, I thought it would be a bit longer than that.

He should be handed over to the International War Crimes Commision in the Hague, but because the US doesnt want its troops tried there they dont recognise its authority.

It isn't the troops who should be tried, its Saddam's handlers from the era in which the crimes the Bush admin has chosen to misrepresent as simple genocide (which were in fact "collateral damage" - according to our own practices and rhetoric - from the Iran/Iraq War). So If he is guilty (and surely he was a monster) then so too his handlers, financiers and arms suppliers from the Regan administration (ala Rummy, Cheney, and numerous others within the Pentagon).

But then, we don't have to obey the rule of law, that's only for weak nations or those Washington decides to villify.
