    Unfortunately, that makes perfect legal sense. The law states that you must either intend to kill (for murder) or have it that a reasonable man would see that death was the only logical outcome of an action (manslaughter) or be so reckless as to your actions that death occurred (such as during a battery).

    Unfortunately this person did not fuilfil the criteria of the crime, so therefore could not be reasonably and fairly found guilty of it. The judges reasoning was entirely accurate- it is the CPS' fault for not trying him for the right crime.

    Just because someone deserved to be found guilty of it does not mean that the law can be ignored in order to get the decision. Morality should play no part ion law because it is subjective not objective.

    Unfortunately that is true. Morality can only come into play when the bill to make the law is being passed. Morality is such a personal thing in many ways, as well, as part of a legal system it paves the way for a religious autonomy in a country. These days, it wouldn't work.

    Does that make sense?

    Now I'm not a lawyer, but I'd have thought that attempted murder would be a reasonable charge in this case.
