Confusing laws

Former MemberFormer Member Posts: 1,876,323 The Mix Honorary Guru
I know in the uk the legal age of consent is 16 weather you are gay or straight, but where im from the legal age of consent for a straight person is 16 and if your gay its 18. What i was wondering is if you're two people (both female) over the age of 16 but under 18 and in a long distance relationship one person in the uk and the other here and were for instance sending explicit texts, would it be breaking the law in any way do you think?

I've been wondering for certain reasons and find it pretty confusing tbh.

I am not a lawyer, but my guess goes something like this:

Both of you would be breaking the law in your country (the offence is likely to be defined as something along the lines of "causing an indecent message to be transmitted to a person under the age of consent").

As your country doesn't know very much about the person in this country, nothing is likely to happen unless they receive a complaint from this country - but that's not likely to happen as it's not illegal in this country (but it could).

Your country could apply for the person in this country to be extradited, or use a European arrest warrant - but that's quite a bit of work so probably wouldn't happen, and because it would be controversial here, diplomacy may prevent it from happening

Yes, that's exactly what I was thinking.

I think the only way any kind of police action would be taken would be if the younger person/their parents reported it. But even then it's very unlikely to lead to a prosecution (from my experience in this kind of thing) and will probably just lead to a "don't do it again" and the older one will maybe end up on an unofficial kind of "watch this person" list for a while.

It's awesome that you're being careful though :thumb:

It does worry me a wee bit tbh, but its like... if one of us were male it'd be completely fine!? but cos we're both female its not... grrr stoopid place i live -.-
But we're almost exactly the same age lol cos our birthdays are pretty close, just a bit of a pain i guess. But its better to be safe than sorry.

I was thinking you were like 2 years apart or so. If you're really close in age I honestly don't think it'll matter to the police, as long as everything is totally consensual (which it sounds like it is).
Is the younger persons parents cool with the relationship? Because that might be the only problem, if the parents make a complaint. But the younger one could still refuse to say anything to the police etc etc.

lol think they'd me more worried bout fact im a girl :P
But like in their country they've above the age of consent...
tbh i think the law over here should be 16 for consent if your gay or straight, i really dont understand it :L

    Nothing will happen at all.
Unless one of you rapes, or murders another... then the texts would be used in evidence. But apart from that, no one would give a hoot. Carry on :)
Or if you wanna mix it up, add me on skype.

I don't think anyone could even know unless you told them.

are the messages just explicitly written? or are there photos as well? if there are, depending on the nature of them, it could be taken as child pornography.. where im from, age of consent is 16, but to send erotic photos, both persons must be 18. thats where it could be troublesome. not sure how it is there, but here it is a very big no-no

Nah no pics just writing really. Tbh i don't think im so worried bout it now i've thought bout it, because in the end where she is she's age of consent its technically me who isn't cos im here - but if one of us was male i would be.. so silly really is :L

I can't think of any law enforcement agency in the land that is going to get involved with the relationship of an 18 year old and 16+ year old if they're exchanging sexy pictures between 2 different countries.
